These Terms of Use ("Terms") are a legal agreement between you and Digital Cowboy ("Semble", "we", "us") governing your use of the Semble mobile application and related services (the "Service"). By downloading or using Semble, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Semble uses artificial intelligence to generate step-by-step repair and installation guides from the manuals, photos, and information you provide. Guides are generated automatically and are provided for general informational and educational purposes only.
2. Safety & accuracy — please read
Semble's guides are AI-generated and may be incomplete, inaccurate, or unsuitable for your specific situation. They are not a substitute for professional advice, manufacturer instructions, or applicable codes and regulations.
You are solely responsible for deciding whether and how to carry out any task. Home repair and installation can be dangerous. For any work involving electricity, gas, plumbing, structural elements, or anything that could cause injury or property damage, consult a licensed professional and follow the manufacturer's official instructions and all local laws and safety codes. Always use appropriate safety equipment. If you are unsure, do not proceed. You assume all risk arising from your use of any guide.
3. Eligibility and your account
You must be at least 13 years old (or the minimum age of digital consent in your country) to use Semble. You are responsible for the accuracy of your account information and for keeping your login secure. You are responsible for activity that occurs under your account.
4. Subscriptions and billing
- Semble offers a free tier with a limited number of guides and a paid subscription, Semble Pro, offered on a monthly or annual basis.
- Subscriptions are sold through Apple and billed to your Apple Account. Payment is charged at confirmation of purchase.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- You can manage or cancel your subscription at any time in your App Store account settings. Deleting your Semble account does not cancel your Apple subscription.
- Except where required by law, payments are non-refundable; refund requests for App Store purchases are handled by Apple.
5. Acceptable use
You agree not to misuse the Service, including: uploading content you do not have the right to use; attempting to disrupt, reverse-engineer, or gain unauthorised access to the Service; using it for unlawful purposes; or uploading content that infringes others' rights.
6. Your content
You retain ownership of the manuals, photos, and other content you upload. You grant us a limited licence to store, process, and transmit your content to our service providers (including AI processing providers) solely to operate and provide the Service to you, as described in our Privacy Policy. You are responsible for ensuring you have the rights to any content you upload.
7. Intellectual property
The Semble app, its design, and its underlying technology are owned by Digital Cowboy and protected by intellectual-property laws. These Terms do not grant you any rights to our trademarks or branding.
8. Disclaimers
The Service and all guides are provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that guides will be correct, complete, or suitable for your task.
9. Limitation of liability
To the maximum extent permitted by law, Digital Cowboy and its providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, injury, or property damage, arising out of or related to your use of (or inability to use) the Service or any guide. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
10. Termination
You may stop using the Service and delete your account at any time in the app. We may suspend or terminate access if you breach these Terms or if necessary to protect the Service or other users.
11. Governing law
These Terms are governed by the laws of South Africa, without regard to conflict-of-law principles. Disputes will be subject to the courts of South Africa, except where applicable consumer-protection law provides otherwise.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Effective date" above. Continued use of the Service after changes take effect constitutes acceptance.
